1. General provisions
- These Terms of Service set out the rules for providing services by electronic means by CLEVER AGENT SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office in Kleosin, entered in the entrepreneurs' register (KRS) under number 0001171512, NIP: 5423499417, REGON: 541662127.
- These Terms are made available free of charge at https://cookiepilot.io/regulamin in a form that allows them to be downloaded, stored and printed.
- Using CookiePilot services constitutes acceptance of these Terms and of the Privacy Policy.
- The Provider renders services in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and the Polish Personal Data Protection Act of 10 May 2018.
2. Definitions
Terms used in these Terms of Service mean:
- Provider — CLEVER AGENT SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office at Józefa Ignacego Kraszewskiego 1 / 16, 16-001 Kleosin, Polska.
- CookiePilot / Service — the Consent Management Platform (CMP) available at https://cookiepilot.io and https://app.cookiepilot.io.
- User — a natural person, legal person or organizational unit without legal personality that uses the Service.
- Account — the User's individual account in the CookiePilot system, providing access to the admin panel.
- Panel — the admin interface available after logging in, used to configure and manage cookie banners.
- Cookie banner — an interface element generated by CookiePilot, displayed on the User's website to collect consents.
- Domain — the web address of the User's website on which the CookiePilot banner is deployed.
- Subscription — a paid plan for using the Service, defining the scope of available features.
3. Type and scope of services
- CookiePilot provides cookie consent management (CMP) services for websites, including:
- Automatic scanning and categorization of cookies on the User's website
- Generating and displaying cookie banners compliant with the GDPR and ePrivacy
- Collecting and storing the consents of website visitors
- Integration with Google Consent Mode v2
- An admin panel for configuring banners
- Consent reports and statistics
- Data export for audit purposes
- Services are provided in a SaaS (Software as a Service) model and accessible through a web browser.

4. Conditions of use
- Using CookiePilot requires:
- A device with internet access
- An up-to-date web browser (Chrome, Firefox, Safari, Edge)
- An active email address
- For paid plans — invoicing details and a payment method
- The User undertakes to:
- Provide true data during registration
- Not share login credentials with third parties
- Use the Service in accordance with the law and good practice
- Not infringe the rights of the Provider or third parties
- It is prohibited to use CookiePilot for:
- Unlawful activities
- Distributing content that infringes the rights of third parties
- Attempts to circumvent system security
- Activities that may disrupt the operation of the Service
5. Registration and account
- Registration on CookiePilot is free and requires providing an email address and creating a password.
- After registration the User gains access to the Panel and may use the Starter (free) plan.
- A User may hold one account. Creating multiple accounts to circumvent limits is prohibited.
- The User is responsible for the confidentiality of login credentials. If unauthorized access is suspected, the password should be changed immediately and the Provider notified.
- The account can be deleted at any time from the Panel or by contacting customer support at pomoc@cookiepilot.io.
6. Payments and subscriptions
- CookiePilot offers the following plans:
- Starter — free, up to 10,000 page views per month
- Pro — EUR 7 net/month, unlimited page views
- Business — EUR 25 net/month, up to 5 domains
- Agency — EUR 69 net/month, unlimited domains
- Prices are net and exclude VAT. VAT is added to net prices at the applicable rate. Billing for Polish customers is issued in PLN; the EUR amounts above are indicative for international customers.
- Payments are processed via the Stripe payment operator or by bank transfer to the Provider's account.
- The subscription renews automatically at the end of each billing period (month or year) unless the User cancels it earlier.
- VAT invoices are issued automatically and available in the Panel and sent to the User's email address.
- For annual payment a 20% discount applies compared to monthly payment.
- Failure to pay on time may result in suspension of access to paid features.
7. Intellectual property rights
- CookiePilot, including the software, interface, logos, texts, graphics and documentation, is the intellectual property of the Provider or its licensors and is protected by copyright and other intellectual-property laws.
- The User receives a non-exclusive, non-transferable license to use CookiePilot within the scope of the chosen subscription plan.
- It is prohibited to:
- Copy, modify or decompile the software
- Remove or hide legal notices
- Resell or sublicense access to the Service without the Provider's consent
- The User retains rights to their own content (banner texts, logos) placed in the Panel.
8. Liability
- The Provider will make every effort to ensure the Service operates without interruption but does not guarantee uninterrupted availability.
- The Provider is not liable for:
- Damage resulting from incorrect banner deployment by the User
- Data loss caused by third parties or force majeure
- Interruptions resulting from planned maintenance
- Actions of supervisory authorities or consequences arising from the User's incorrect configuration of the Service
- The Provider's liability is limited to the amount of fees paid by the User over the last 12 months.
- The User is responsible for the compliance of their own website with applicable law.
9. Complaints
- Complaints regarding the operation of the Service can be submitted electronically to pomoc@cookiepilot.io or via the contact form at https://cookiepilot.io/kontakt.
- A complaint should include:
- The User's identifying data (email address, account name)
- A description of the problem and the circumstances of its occurrence
- The expected resolution
- The Provider will consider the complaint within 14 days of receiving it.
- The User will be informed of the outcome electronically.
10. Right of withdrawal
- A User who is a consumer has the right to withdraw from the contract within 14 days of its conclusion without giving a reason.
- To exercise the right of withdrawal, an unequivocal statement must be sent electronically to kontakt@cookiepilot.io.
- In the event of effective withdrawal, the Provider will refund all payments received within 14 days of receiving the statement.
- The right of withdrawal does not apply if the Provider has fully performed the service with the consumer's express consent.
11. Protection of personal data
- The controller of Users' personal data is CLEVER AGENT SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ.
- Detailed information about the processing of personal data is available in the Privacy Policy.
- CookiePilot processes the data of end users (visitors to Users' websites) solely as a processor on the basis of a data processing agreement.
- The User is the controller of personal data collected on their own website and is responsible for processing it lawfully.
12. Changes to the Terms
- The Provider reserves the right to change the Terms for important reasons, such as changes in the law, the introduction of new features or changes in service conditions.
- Users will be notified of changes to the Terms electronically at least 14 days before they take effect.
- Continued use of the Service after the changes take effect constitutes acceptance of the new Terms.
- If the User does not accept the changes, they may terminate the contract before the changes take effect.
13. Final provisions
- These Terms take effect on 2025-01-18.
- The law applicable to contracts concluded under these Terms is Polish law.
- Any disputes will be resolved by the court competent for the Provider's registered office, subject to consumer rights.
- In matters not covered by these Terms, the relevant provisions of Polish law apply.
